Terms and Conditions

This document is an electronic record published in accordance with the provisions of the Information Technology Act, 2000, the rules made thereunder, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Spectacom Global Private Limited is a company registered in India under the Companies Act, 2013, having its registered office at 809 Udyog Vihar, Phase V, Gurugram (Haryana) – 122016 (referred to as "SGPL", "we", "our" or "us") in these Terms and Conditions ("T&Cs"). The terms "you", "your" or "User" refer to all individuals and/or entities browsing, accessing or using the mobile application and/or the website www.getmybib.com (collectively referred to as the "Platform"), for ordering any Product (as defined below), creating a User Account, availing the Services (as defined below), or for any other purpose. "Event Organizer" means a third party that lists, markets or sells Products through the Platform, including entries, tickets or merchandise relating to its own current or future events, and includes its sub-brands.

These T&Cs form a binding agreement between you and/or the relevant Event Organizer (as applicable) and SGPL and its affiliates and subsidiaries. Please familiarise yourself with these T&Cs, Our Privacy Policy, and any other terms and conditions published on the Platform (collectively, the "Policies"), before you use the Platform. By accessing, browsing, using, registering with, or placing an order on the Platform, you confirm that you have read, understood, and expressly agree to be bound by the Policies in their entirety.

You also confirm that you have read, understood, and expressly agree to be bound by the specific terms and privacy policy of the Event Organizer(s) from whom you purchase Products or with whose events you register. If you do not agree to the Policies, or the specific terms of the relevant Event Organizer, please do not download, install, or use the Platform.

We may, from time to time, change the Policies that govern your use of the Platform. Please check the Policies, and the terms of the Event Organizer whose Products you intend to purchase, each time you use the Platform. We reserve the right to change the format or content of the Platform, or suspend its operation for maintenance or any other reason, at our sole discretion.

1. Eligibility and Minors

Only persons who can enter into legally binding contracts under the Indian Contract Act, 1872, i.e., persons who are 18 (eighteen) years of age or older, of sound mind, and not otherwise disqualified from contracting under Applicable Law, may register a User Account, purchase a Product, or directly accept these T&Cs on the Platform.

If you are under the age of 18 (eighteen) years (a "Minor"), you are prohibited from directly creating a User Account, registering for an event, or purchasing a Product on the Platform. A Minor may access the Platform only through a parent or lawful guardian who is of legal age to form a binding contract under the Indian Contract Act, 1872. Such parent or lawful guardian shall (a) accept these T&Cs, the applicable Event Organizer's terms, and any associated Policies on behalf of the Minor; (b) be treated as the contracting party for all purposes under these T&Cs; and (c) assume full legal and financial responsibility for the Minor's registration, participation, and conduct.

Where We become aware that a Minor is using or has registered on the Platform without the participation of a parent or lawful guardian as required above, We reserve the right to deny or suspend that Minor's access and cancel any related order or registration, without further notice.

2. Definitions

"Applicable Law" shall mean any and all: (i) laws, statutes, constitutions, treaties, rules, regulations, ordinances, codes, guidance; and (ii) all judicial, executive, legislative, administrative or military orders, directives, decrees, injunctions, judgments, permits, agreements, and other legal requirements, of, with, or adopted or imposed by any governmental authority, now or hereafter in effect, as amended from time to time.

"Data Protection Law" shall mean the Digital Personal Data Protection Act, 2023 and rules made thereunder, the Information Technology Act, 2000 and rules made thereunder, and any other Applicable Law governing the protection, security, or privacy of Personal Data.

"Personal Data" shall have the meaning given to it in Our Privacy Policy, which governs the collection, use, storage, sharing, and protection of your Personal Data.

"Event Organizer" means a third party that lists, markets or sells Products through the Platform, including entries, tickets or merchandise relating to its own current or future events, and includes its sub-brands.

"Products" shall mean tickets to an Event Organizer's events or any other current or future events, as well as merchandise related to the same, including its sub-brands, offered for sale to you on the Platform.

"Services" shall mean the ticketing, registration and marketplace services provided by SGPL through the Platform, enabling Event Organizers to offer Products to Users, and any ancillary services offered by SGPL in connection therewith.

"User Account" means the account You may create on the Platform to browse, register for, or purchase Products.

"Intellectual Property Rights" shall mean and include: (i) all rights, title, and interest under any statute or Applicable Law including patent rights, copyrights including moral rights, trademark and design rights, and any similar rights anywhere in the world; (ii) any licences, permissions and grants in connection therewith; (iii) applications for any of the foregoing; (iv) the right to obtain and hold registrations anywhere in the world; (v) extensions and renewals thereof; and (vi) causes of action, past, present or future, related thereto.

3. Our Services

The Platform is a ticketing, registration and marketplace platform that enables independent, third-party Event Organizers to list, market and sell Products to Users, and enables Users to browse, register for, and purchase such Products. SGPL is not an Event Organizer and does not itself organise, manage or bear responsibility for any event listed on the Platform.

You may browse the Platform, create a User Account, and purchase Products offered by Event Organizers. Depending on the Event Organizer and the Product, you may be required to provide additional information or accept additional terms specific to that Event Organizer or its event before completing a purchase or registration.

We reserve the right to refuse the provision of any Services to you. We also reserve the right, but are not obligated, to limit the Services to any person, geographic region or jurisdiction.

4. Account Registration

You may create a User Account on the Platform; however, you may also use the Services and/or purchase Products without creating one, where the Platform permits. At the time of registration, you shall ensure that the User Account information provided is complete, accurate and up to date. You may be requested to provide supporting documents as specified by SGPL, in accordance with Applicable Law.

You are responsible, at all times, for maintaining the confidentiality of your User Account information and password, and for all activity that occurs under your User Account. You agree to (i) immediately notify SGPL of any unauthorised use of your User Account or any other breach of security; and (ii) log out of your User Account at the end of each session. SGPL is not liable for any loss or damage arising from your failure to comply with this Clause. Use of another User's Account is expressly prohibited.

5. Our Relationship with Event Organizers

Agency. The relevant Event Organizer authorises SGPL to act as its agent for the sale of its Products on the Platform, which includes facilitating the payment process and delivering the purchased Product (such as a ticket) to you by email or through the Platform. The underlying contract for the event, entry or merchandise is between you and the Event Organizer, and is governed by the Event Organizer's own terms and policies. The Event Organizer is solely responsible for the delivery of, and performance in connection with, any Product or event purchased through the Platform. SGPL does not control or supervise the organisation, conduct, safety, scheduling, cancellation or execution of any event except to the limited extent expressly agreed in writing.

Pricing of Products. Each Event Organizer is entitled to determine the base price of the Products it lists on the Platform. SGPL charges a processing fee for every Product sold through the Platform, which is included in the final price displayed to you. SGPL is responsible only for the taxes applicable on its own processing fee; the Event Organizer is responsible for the taxes applicable on its Products. SGPL shall be entitled to retain the processing fee charged on a Product notwithstanding any subsequent refund, return, or cancellation of the underlying event, for reasons not attributable to SGPL.

Returns and Refunds. Returns and refunds for Products purchased on the Platform are governed by the policies of the relevant Event Organizer. All return or refund requests must be sent by you to the Event Organizer, using the contact details communicated to you by that Event Organizer.

Duties of the Event Organizer. Each Event Organizer shall not use the Platform to upload, post, transmit or make available any information or Product that does not comply with Applicable Law, or that is threatening, abusive, defamatory, obscene, misleading, hateful, or racially, ethnically or otherwise objectionable, and shall ensure that its event does not incorporate or promote any unlawful, immoral, obscene, hateful, violent, sexually explicit or unethical activity, or harm minors in any way. An Event Organizer shall immediately inform SGPL of any unavailability of its Products, or any inaccuracy in its listings or information relating to it published on the Platform, and shall notify SGPL in writing if it wishes to remove a listing from the Platform.

SGPL's Right to Suspend or Remove Listings. Where SGPL suspects that an Event Organizer is misusing the Platform or violating any Policies, SGPL has the right to suspend or permanently remove that Event Organizer's listings, and may deactivate its account on the Platform. SGPL may, at its sole discretion, with or without reason and without penalty, discontinue providing access to the Services, or any part thereof, to an Event Organizer without notice.

Warranty of the Event Organizer. Each Event Organizer warrants to SGPL that: (i) it has the right to authorise SGPL to act as its agent for the sale of its Products on the Platform; and (ii) it has all necessary approvals for organising its event in India. An Event Organizer shall immediately inform SGPL of any change to the foregoing.

6. Use of the Platform

You will use the Platform in accordance with Applicable Laws and will not use it in a way that infringes the rights of anyone else, including their Intellectual Property Rights, privacy, publicity, or contract rights, or that restricts or inhibits anyone else's enjoyment of the Platform.

You have a limited licence to access and use the Platform solely to avail the Services, identify and purchase Products, and process returns and refunds in accordance with these T&Cs. Without Our prior written consent, you may not:

  • copy, reproduce, crawl, frame, republish, download, print, post, distribute, re-post, broadcast, record, transmit, edit, communicate to the public, or deep-link into the Platform or its underlying code;
  • use the Platform or any content on it, including Product listings, descriptions or prices, for any commercial purpose, or resell any Product other than as contemplated by these T&Cs;
  • download or copy the login credentials of another User;
  • use data mining, robots, spiders, or similar tools to extract any part of the Platform; or
  • create or publish your own database featuring any part of the Platform.

SGPL has no obligation to monitor your use of the Platform but may do so to ensure compliance with the Policies, comply with Applicable Law or a governmental or judicial order, detect or prevent fraud or security issues, respond to support requests, or protect the rights, property, or safety of SGPL, Event Organizers, Users, or the public.

7. Use of the Platform from Outside India

Except where otherwise specified, the materials on the Platform are displayed solely to promote the Products of Event Organizers available in India. Users who access the Platform from outside India are entirely responsible for compliance with the Applicable Laws of that jurisdiction. These T&Cs do not constitute, and may not be used in connection with, any promotional activity or solicitation in a jurisdiction where such activity is not authorised.

8. Submissions and Intellectual Property Licence

This clause governs any comments, blogs, feedback, suggestions, questions, ideas, artwork, images, or other content you submit, upload, or otherwise disclose to SGPL on or through the Platform or any SGPL social media channel, other than your Personal Data, which is governed exclusively by the Privacy Policy (collectively, "Submissions").

By making a Submission, you grant SGPL a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable, and transferable licence to use, reproduce, modify, adapt, publish, distribute, publicly display, and create derivative works from that Submission, in any media now known or hereafter devised, for purposes connected with SGPL's Services, marketing, and Platform operation.

You warrant that you own, or have all necessary rights and consents to grant the licence in, each Submission you make, that it does not infringe any third party's rights, and that it is not defamatory, unlawful, or otherwise injurious to any person. You agree to indemnify SGPL and its affiliates against any third-party claim arising out of a breach of this warranty.

Submissions are treated as non-confidential and non-proprietary as between you and SGPL for the purposes of the licence above. SGPL may disclose your identity to a third party who claims that a Submission infringes their Intellectual Property Rights or right to privacy, where required or permitted by Applicable Law.

SGPL reserves the right, at any time and at its sole discretion, to remove, suspend, edit, or disable access to any Submission it considers objectionable, in violation of these T&Cs, or otherwise harmful to the Platform.

If a Submission provided by you is found to be false or inaccurate, SGPL may reject your registration, cancel your orders, and restrict your use of the Services, without prior notice.

9. Social Networking Sites

Any Submissions you make on a third-party website or page, such as Facebook, Instagram, X, YouTube or any other platform ("Third Party Platform"), are governed by the terms of use and policies of that Third Party Platform. You should read those terms before posting, and any use of a Third-Party Platform is entirely at your own risk. Content posted on any Third Party Platform does not necessarily reflect SGPL's views, and SGPL is not responsible for it.

10. Intellectual Property

All rights, including copyright and other Intellectual Property Rights, in and to the Platform, and arising out of the Services, are owned by or licensed to SGPL. All Intellectual Property Rights in the Products are owned by or licensed to the relevant Event Organizer. We grant you a non-exclusive, limited, royalty-free, and revocable licence to use the Platform to avail the Services and purchase Products. This grants you no rights in Our Intellectual Property Rights, or those of any Event Organizer or other third party.

All trade names associated with SGPL and logos denoted with ™ or ® are trademarks or registered trademarks of SGPL or its affiliates. These marks may not be used in connection with any product or service that is not an SGPL product or service, without SGPL's prior written consent.

11. Personal Data

Any Personal Data you provide to Us, or that We collect through your use of the Platform, is collected, used, stored, shared, and protected in accordance with, and only to the extent you have consented under, Our Privacy Policy. Where you purchase a Product or register for an event, We share your relevant Personal Data with the concerned Event Organizer as described in Our Privacy Policy, so that it may deliver the underlying event or Product to you; such Personal Data is thereafter governed by that Event Organizer's own privacy policy.

12. Confidentiality

User Content. As set out in Clause 8, Submissions are treated as non-confidential and non-proprietary for the purposes of the licence granted to SGPL.

Your Confidentiality Obligations. During your use of the Platform, you may receive information relating to SGPL or its Services that is not known to the general public ("Confidential Information"). You agree that: (a) Confidential Information remains SGPL's exclusive property; (b) you will use it only as reasonably necessary for your use of the Services; (c) you will not disclose it to any other person; and (d) you will take reasonable measures to protect it. You may not issue a press release, make a public statement, or use SGPL's name, trademarks, or logo in promotional material without SGPL's prior written permission.

13. User Warranties and Prohibited Content

You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, or sharing on or through the Platform any information that:

  • belongs to another person and to which you do not have any right;
  • is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or is otherwise inconsistent with or contrary to Applicable Law;
  • is harmful to a child in any way;
  • infringes any patent, trademark, copyright, or other Intellectual Property Rights;
  • deceives or misleads the recipient about the origin of a message, or is grossly offensive or menacing in nature;
  • impersonates another person, including SGPL or an Event Organizer;
  • threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of a cognizable offence, prevents investigation of an offence, or insults another nation;
  • engages in any form of antisocial, disruptive, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing" and "griefing" as those terms are commonly understood and used on the internet;
  • contains a software virus or other code designed to interrupt, damage, or limit the functionality of any computer resource, or that probes, scans, hacks, or tests the vulnerability of the Platform;
  • makes false or malicious statements against SGPL, an Event Organizer, its Products, the Services, or the Platform; or
  • otherwise violates these T&Cs or any Applicable Law.

SGPL reserves the right, without prior notice, to remove, suspend, edit, or disable access to any content it considers, in its reasonable discretion, to fall within the above categories, and to investigate and pursue all available legal remedies, including cooperating with law enforcement authorities.

14. Grievance Redressal and Intermediary Compliance

Where the Platform hosts Submissions or other User-generated content, SGPL acts as an intermediary and follows the due-diligence requirements of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

SGPL will acknowledge a complaint concerning content that violates Clause 13 within 24 (twenty-four) hours of receipt, and will endeavour to resolve or dispose of such complaint within 15 (fifteen) days of receipt. Where SGPL receives an order from a court of competent jurisdiction or an appropriate government authority requiring removal of, or disabling access to, any content, SGPL will act upon such order within 36 (thirty-six) hours.

If your complaint relates to a Product, an Event Organizer's event, or information published by an Event Organizer on the Platform, you may contact the relevant Event Organizer directly. If your complaint relates to the Platform, the Services, or any other matter within SGPL's control, you may raise it with Our Grievance Officer:

The Grievance Officer will acknowledge receipt of a grievance within 48 (forty-eight) hours and endeavour to redress it within 30 (thirty) days, to the extent applicable to SGPL's activities.

15. Disclaimer of Warranties and Accuracy of Content

We try to ensure that information on the Platform, including any information published by an Event Organizer, is correct at the time of inclusion, but We do not guarantee its accuracy, completeness, or currency, and disclaim all warranties in this respect to the extent permitted by Applicable Law. We are not responsible for the content or information of Event Organizers made available on the Platform. Views expressed in User-generated content are those of the relevant User and do not represent SGPL's views. Any use of the Platform or its content is at your own risk. Spectacom uses reasonable efforts to ensure that the Platform is free from viruses and other malicious or harmful content. However, we cannot guarantee that your use of the Platform (including any content on it or any website accessible from it) will not cause damage to your computer or other device. It is your responsibility to ensure that you have the right equipment (including antivirus software) to use the Platform safely. Except where required by Applicable Law, Spectacom shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful content that they access from or via the Platform. Nothing on the Platform constitutes an invitation to invest in SGPL or its affiliates. The Platform and the Services are provided on an "as is" and "where is" basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by Applicable Law. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any Product will meet your expectations.

16. Limitation of Liability

SGPL acts solely as an agent of the relevant Event Organizer in facilitating the sale of Products, and is not the seller of record for, and assumes no liability in respect of, the quality, safety, delivery, or performance of any Product or event. Your recourse in respect of a Product or event is against the relevant Event Organizer, in accordance with its own terms and policies.

Subject to Clause 16, SGPL's aggregate liability arising out of or in connection with your use of the Platform or the Services, whether in contract, tort, or otherwise, shall not exceed the processing fee, if any, actually received by SGPL in respect of the specific transaction giving rise to the claim.

SGPL shall not, under any circumstance, be liable for any incidental, special, or consequential damages, including loss of profits or revenue, arising out of or in connection with these T&Cs, the Platform, or the Services, even if SGPL has been advised of the possibility of such damages.

We are not responsible for, and disclaim liability in connection with, the security practices, content, or policies of an Event Organizer, a Third Party Platform, or a third-party service provider engaged by you independently of SGPL.

17. Indemnification

You agree to indemnify, defend and hold harmless SGPL, its officers, directors, employees and agents from and against claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these T&Cs; (b) your provision of inaccurate, incomplete or fraudulent information to Us or an Event Organizer; (c) your violation of Applicable Law; or (d) your infringement of a third party's rights, including in connection with a Submission you make. Where the User is a Minor, this indemnity is given by, and is enforceable against, the parent or lawful guardian who accepted these T&Cs on the Minor's behalf, and not against the Minor personally.

18. Communications and Marketing Consent

By providing your consent, you agree to receive news, updates, and offer or campaign-related communications, by SMS, WhatsApp, call, email or other electronic means, at the contact details you provide. By accessing and using the Platform and/or verifying your contact number with Us, you explicitly consent to receive such communications from Us, Our authorised representatives, or the relevant Event Organizer regarding new Services or offerings.

You may unsubscribe or opt out of receiving marketing or promotional communications, newsletters and other notifications from Us at any time by following the instructions in such communications or by contacting Our customer care. To unsubscribe from communications sent by an Event Organizer, please refer to that Event Organizer's own terms and conditions.

19. Other Legal Notices

There may be legal notices in other areas of the Platform relating to your use of it, all of which, together with the Policies, govern your use of the Platform.

20. Modification of these T&Cs

We may update, replace, or amend these T&Cs from time to time to comply with Applicable Law or to reflect Our changing business requirements, without prior notification. Updates will be posted on the Platform and, unless stated otherwise, take effect immediately upon posting. We encourage you to review these T&Cs periodically. Your relationship with the Platform is governed by the most current version of these T&Cs, as published on the Platform.

21. Assignment and Third-Party Rights

You may not assign or sub-contract any right or obligation under these T&Cs without Our prior written consent. We may assign, transfer, or sub-contract any of Our rights or obligations under these T&Cs to any third party at Our discretion. Only you and SGPL may enforce these T&Cs; no third party, including an Event Organizer, has any right to do so, save as expressly provided herein.

22. No Waiver of Rights

No relaxation or delay by SGPL in exercising any right or remedy under these T&Cs operates as a waiver of that right or remedy, nor affects SGPL's ability to subsequently exercise it. Any waiver by SGPL must be in writing.

23. Severability

Each section of these T&Cs shall be interpreted, wherever possible, to be valid under Applicable Law. If any provision is found illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be ineffective only to the extent of such invalidity, without affecting the remainder of these T&Cs, which shall remain in full force and effect.

24. Entire Agreement

The Policies, including these T&Cs and the Privacy Policy, together with the specific terms and privacy policy of the relevant Event Organizer, set out the entire agreement between you and SGPL in relation to your use of the Platform, and supersede any prior terms, conditions, or representations, to the fullest extent permitted by Applicable Law.

25. Governing Law and Jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of India, and any dispute arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana.

26. Notices

All notices and communications shall be in writing, in English, and deemed given if delivered personally, by commercial courier, by registered or certified mail (return receipt requested), or by email, to:

27. Force Majeure

SGPL shall not be responsible for any delay, loss, damage, or failure to comply with its obligations under these T&Cs to the extent such failure arises from a cause beyond SGPL's reasonable control ("Force Majeure Event"), including but not limited to pandemic, epidemic, fire, flood, explosion, act of God, civil commotion, strike, lock-out, industrial action, riot, insurrection, war, act of government, cyberattack, or power failure.

28. Interpretation

Headings, subheadings, and titles are for information only and do not form part of the operative provisions of these T&Cs. Words denoting the singular include the plural, and words denoting any gender include all genders. The words "include" and "including" are to be construed without limitation.
